Data Processing Agreement (DPA)

This Data Processing Agreement is entered into between:

  • You (the Mover/Company) – “Data Processor”
  • Bina Movers – “Data Controller”

1. Purpose of Processing

Mover companies process customer information solely for:

  • Viewing job requests
  • Providing quotations
  • Conducting site visits when needed
  • Executing moving and packing services

2. Categories of Customer Data Shared

  • Name, phone number, email address
  • Pickup and destination locations
  • Home size, inventory, and photos
  • Scheduling details
  • Customer notes and service requests
  • Additional metadata such as timestamps and location preferences
  • The customer's consent status (opt-in Step 6B lead-sharing)

3. Data Processor Obligations (Movers)

  • Use customer data strictly for service-related purposes
  • Apply security measures that comply with the Kenya Data Protection Act (2019)
  • Prohibit sharing, selling, or exporting customer data
  • Only contact customers for quotation and service delivery
  • Implement staff confidentiality practices
  • Delete customer data after completing services
  • Report any data breach within 48 hours

4. Sub-processor Use

You may involve third parties (e.g., your staff or logistics teams) strictly for fulfilling the job. All sub-processors must comply with this DPA and with the Data Protection Act of Kenya.

5. Lawful Basis

Bina Movers processes data based on:

  • Customer consent (Step 6B opt-in)
  • Contractual necessity (fulfilling requested services)
  • Legitimate interest in fraud prevention and platform security

Acceptable Use Policy

6. Acceptable Use Requirements

As a mover using the Bina Movers platform, you agree to the following restrictions:

  • No spamming customers with unrelated offers
  • No harassment, abusive language, or intimidation
  • No creation of fake accounts or false bids
  • No usage of bots or automated bidding systems
  • No scraping, exporting or reusing platform data
  • No misrepresentation of services or pricing

7. Prohibited Conduct

  • Sharing customer data with external parties
  • Using customer data for marketing without consent
  • Attempting to hack, modify, or reverse engineer the platform
  • Submitting fraudulent documents or identity information

Data Retention Policy

8. Retention of Customer Data

  • Pending Quote Requests: retained for up to 90 days
  • Completed Move Records: retained for up to 12 months
  • Mover Account Information: stored while an account is active
  • Audit Logs & Security Logs: stored for 12–24 months for fraud and compliance

9. Deletion of Data

  • Once a mover account is deleted, all associated customer data is erased
  • Upon request, customers can request deletion of their information
  • Mover companies must delete customer data from their own systems when no longer needed

DMCA / Copyright Policy

10. Reporting Copyright Violations

If you believe any content on the platform violates your copyright, you may submit a DMCA request to:

Your DMCA Report Must Include:

  • Your full legal name and contact details
  • A description of the copyrighted material
  • Proof of ownership or authorization
  • The URL or location of the infringing content
  • A sworn statement under penalty of perjury

11. Counter-Notification Process

If we remove content due to a DMCA report, the mover may file a counter-notice containing:

  • Identification of the removed material
  • A statement of good-faith belief that the removal was mistaken
  • Consent to Kenyan jurisdiction for legal proceedings

12. Platform Role

Bina Movers operates as a marketplace platform. We do not own or operate moving companies.

13. No Warranty

Bina Movers makes no warranties regarding mover performance, pricing, delivery timelines, or service outcomes.

14. Limitation of Liability

  • Bina Movers is not responsible for loss, damage, theft, or disputes between parties
  • Movers are fully responsible for their own employees, vehicles, and pricing
  • Customers agree to engage movers at their own discretion

15. Legal Compliance

All users must comply with Kenyan laws including:

  • Data Protection Act (2019)
  • Consumer Protection Act
  • Computer Misuse and Cybercrimes Act
